A Power of Attorney is a legal document through which you are able to appoint a person you trust as your attorney to act on your behalf in matters of personal care or property handling. There are two types of Power of Attorneys in Ontario:- A Power of Attorney for Personal Care enables a donee to make decisions regarding personal care matters of the donor such as health care, housing, and all other matters of personal life in the unfortunate event that the donor becomes mentally incapable of taking these decisions on his/her own.
- A Power of Attorney for Property can be a General Power of Attorney for Property or a Continuing Power of Attorney for property. The former allows a donee or attorney to take decisions on behalf of donor in matters of sale, lease, payment of bills, maintenance of house/property, and management of all financial matters only until the donor is in sound mental condition. The latter continues to be valid even when the donor is no longer mentally capable of taking financial decisions on its own.
